The Missouri Supreme Court on Tuesday overruled Mark Woodworth's request for a rehearing, asking the state's high court to appoint an independent prosecutor in the case.
According to defense attorney Bob Ramsey, The Missouri attorney general's office will be allowed to stay on the case.
The Supreme Court had ruled earlier this month that Woodworth should be released from custody, unless the state petitioned for a retrial. The Missouri attorney general's office last week filed a motion with the state's high court to retry Woodworth.
After a mandate is issued, it is expected that Woodworth will be returned to the custody of the Livingston County sheriff, and that a bond hearing will take place, via the Missouri Circuit Court.
